Lis Bonne Atelier's General Terms and Conditions

 

General
Thanks you for your interest in our products! These terms and conditions apply to all purchase orders submitted to Lis Bonne Atelier’s webshop on www.lisbonneatelier.com (in the following referred to as the Webshop), covering all purchase agreements that a consumer enters into online with Lis Bonne Atelier LTD, hereinafter referred to as Lis Bonne Atelier. We encourage you to read these terms and conditions in their entirety before submitting an order. These terms and conditions may be updated and vary from time to time, which is why we ask you to read the terms and conditions previous to every order you place in the Webshop.

A binding purchase agreement is entered into as soon as your order has been confirmed by us and an order confirmation has been sent from Lis Bonne Atelier to the e-mail address you submitted. If a product happens to run out of stock before the status has been correctly updated on the Webshop, Lis Bonne Atelier will notify you of this by e-mail. We will then cancel the order in question and refund your purchase. If incorrect price information has been shown on the Webshop you will be given the opportunity to either purchase the product at the correct price, or cancel the order. Lis Bonne Atelier reserves the right to decline or rescind a purchase agreement if fraud or other actions similar to fraud, such as unlawful use of another person’s credit card, are suspected.

To place an order in the Webshop you must be at least 18 years old and not under guardianship. Lis Bonne Atelier presumes that minors who carry out purchases on www.lisbonneatelier.com submit truthful information of their age and/or possess the necessary consent from their custodian to purchase the product(s). If not, the buyer may become liable for the possible costs an invalid agreement may involve.

By accepting these General Conditions, you understand and accept that any order, purchase or transaction is made exclusively between the Company and the Customer.

Orders

When you receive an order confirmation from us your purchase order is accepted and a purchase agreement is entered into. We encourage you to save the order confirmation for any future contacts with us. We may deny a purchase order for various reasons, for example if you provide incorrect personal data and/or have a record for non-payment of debt.

You may withdraw your order until it has been confirmed by us. We will then refund any payment that you, or your pay- or credit card company, have made for the order.

We may cancel an order if the products ordered are sold out. We will then refund any amount paid and notify you about equivalent products if such are available.

All products ordered remain our property until we have received full payment for them.

Prices
Occasionally there may be information in the Webshop that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the Webshop is inaccurate at any time without prior notice (including after you have submitted your order).

The prices indicated on the Website apply to orders placed on the Website. All prices are in the currency stated on the Website and include VAT where specified (depending on where you reside VAT may however not be applicable to your purchase). If nothing else is stated on the Website the prices do not include payment- or shipping fees and these are given separately. Please note also that local charges (such as currency conversion fees, credit or bank card fees, sales tax, customs duty etc.) may apply depending on where you live and local regulations. Such charges are at your expense and will not be refunded by us.

Discounted product(s) are available as long as they do not run out of stock. Vouchers or discount codes are only valid once per person and purchase and only within the stated period of time, and may not be combined or transferred to another purchase, nor credited to a new product(s) due to an exchange.

Taxes
Within EU:
All relevant taxes and duties will be included in your final purchase price

Shipments to the UK:
Local taxes and duties will apply to all purchases above 135 GBP.

Shipments to Norway:
We are registered for VOEC, meaning all taxes and duties are included when buying goods with a value of maximum 3000 NOK. Goods with a value above 3000 NOK, taxes and duties will apply. For more information about VOEC, please visit Skatteetaten.no here

Payment
Payment is possible in the currencies set out in the Webshop. Payment is currently made in Swedish kronor (SEK) for shipments to Sweden and Norway, Euro (€) for shipments within the European Union and GBP (£) to the UK.

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

Lis Bonne Atelier reserves the right to check the cardholder’s address, the card’s validity, and that your account has the capacity to be charged with the full amount. Lis Bonne Atelier reserves the right to decline a purchase.

Please note we are currently unable to accept merchandise cards, cash or checks as payment in the Webshop.

Delivery
Lis Bonne Atelier accepts and processes the purchase orders in the same succession that they are submitted to the Webshop. The time of delivery is the day that the product(s) is available for collection. Normally the standard time of delivery within Sweden is 1-3 business days (Mon-Fri) after Lis Bonne Atelier has accepted and confirmed your order. For EU and UK shipments, standard delivery times are normally 3-5 business days (Mon-Fri) with DHL. 

All shipping costs will be specified in the purchase order, so that the cost is clearly visible to you prior to completing the order.

Packages returned as undeliverable
If a purchase sent to you is returned as undeliverable, we reserve the right to charge you a fee covering the entire cost of the shipping and processing. Non-collected packages are normally not covered by the right to return product(s) as well as the returned order.

Delay
Should your order be delayed you will receive a message of this, including a new suggested time of delivery, at the latest within 30 days after you submitted your order. You may cancel the order if you do not accept the new suggested time of delivery. If your order has been delayed, and the new suggested time of delivery has been accepted but the order has not yet been delivered within 15 working days after the new estimated time of delivery, you may always cancel the order by notifying our customer services team. If such a delay should occur, whereby you choose to cancel the order, we will refund the prepaid amount to you. If the order has already been dispatched you will have to return the ordered product(s) in order to receive repayment. We will pay the cost of the return.


Returns and Exchanges

You are always entitled to return your product(s) within 14 days from the time of receiving your order. You may return the product(s) online. Please note that we charge 79 SEK for returns.

If you would like to return your purchase, send us an email to support@lisbonneatelier.com with the following information:

  • Order number
  • Full name
  • Email address
  • Which product(s) you would like to return

For the return to be accepted the returned product(s) must be essentially in the same condition in which they were sold and with any seals intact. This does not apply if the product(s) were damaged or otherwise changed due to any measure necessary to examine them, or due to any other circumstance not related to the consumer.

Lis Bonne Atelier will refund the price of the product(s) as soon as possible, however at the latest within 14 days from the date the product(s) was returned and received by us.

The funds will be returned to your original method of payment. If you paid using your credit card, the amount will be repaid to the same card.

Colours
We cannot guarantee that the colors appearing in the Webshop reflect the clothes’ colors in reality. The colors can be reflected in different ways depending on for example your computer or phone screen, graphic card and the computer settings.

Warrenty and Complaints
Some of our products may come with warranties. Information about such warranties is provided on the Website or in these General Conditions. The order confirmation is the certificate of warranty. Our warranties cover only original manufacturing defects and accordingly not faults arising upon or after any individual changes of the function and/or appearance of the products, such as rebuilding, upgrading or other configuration of the products.

You may, within 2 years (or such longer period prescribed by applicable mandatory law) from the day that you received the products, file complaints regarding products that are defective according to applicable consumer protection legislation. You must then send us a complaint containing your name, address, e-mail address, the order number and a specification of the products that the complaint relates to, for example by using the web form on the Website. You must also file the complaint as soon as possible after the discovery of the defect. Any filing of complaint made within two months from the discovery of the defect will always be considered filed in due time.

We will refund you for defective products in accordance with applicable consumer protection legislation and carry the cost for return delivery of the products to us. We strive to perform such refund within 30 days from receipt of a complaint and finding that a refund shall be made, but this time may be delayed depending on the nature of the product. We also strive to comply with any guidelines regarding defective products provided by the relevant national consumer protection authorities. The refund will be paid with the same payment method that you used to pay the order for the complaint products unless otherwise agreed.

Limitation of Liability

Where applicable mandatory law does not provide otherwise, our liability is limited to direct damages and under no circumstances are we liable for indirect damages such as loss of earnings etc.

Intellectual Property Rights

The Website and all its content is owned by us or our licensors and protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout and information on products, services and other content may not be copied or used without our prior written consent.

Waiver

We reserve ourselves for any image or typographical errors on the Website, such as errors in product descriptions, technical specifications, inaccurate prices or incorrect information with regards to whether a product is in stock. We are entitled to rectify any obvious errors and, at any time, to change or update the information on the Website accordingly.

The images on the Website are for illustration purposes only and do not guarantee to reproduce the exact number of products that you would receive at an order, nor the exact appearance, function or origin of the products.

Governing law and disputes

In the event of a dispute, we strive to comply with any decision by the relevant national consumer protection authorities.

Any dispute regarding the interpretation or application of these General Conditions shall be governed by and construed in accordance with the laws of the country or state where we conduct our business and shall be subject to the non-exclusive jurisdiction of the court at the place of our incorporation. “Non-exclusive jurisdiction” means that you may bring a claim against us in another jurisdiction if provided by applicable mandatory law.

Force Majeure
Lis Bonne Atelier shall not be liable for any damages, loss, or penalties caused by the non-performance in accordance with these Terms due to circumstances of its control including but not limited to in case of war, warlike events, civil war, revolution, rebellion, government action, strike, lockout, blockade, natural catastrophes or similar event, technical problems, failure of electrical / telecommunication / data communications or other communications, as well as defects or delays in services from subcontractors due to circumstances stated herein. If such circumstances occur, We will try to inform you.

Processing of personal information
When shopping on the Website, we will store some of your personal information in order to carry out your purchase. You have the right to request access to your data, and if any information is incorrect, you can have it changed or removed. Lis Bonne Atelier does not store or handle any banking or credit card information. We may also use cookies, e.g. to enhance your experience of the Website.

Changes to the terms
Lis Bonne Atelier reserves the right to modify these Terms at any time. Any changes to these Terms will be posted on the Website. Changes apply from the time they are set out on Website and are able for you to review.
